Q.1-     What are the fire risk premises / occupancies that require Fire Safety Recommendation / Fire Safety Certificate (NOC)?
Ans: -   According to Rule-9 and 10 of Odisha Fire Prevention and Fire Safety Rules, 2017 r/w Odisha Fire Prevention and Fire Safety (Amendment) Rules, 2019 the fullowing classes of premises or occupancies are likely to have risk of fire, namely: -

  • (a) Aerodromes, airports and airstrips;
  • (b) Cinema Halls and Multiplexes;
  • (c) Explosives or fireworks or hazardous substances (manufacturing, storage, transportation, display and sale etc.);
  • (d) Factories and Industries;
  • (e) Depot of Petruleum and other inflammable substances and refineries (Storing, handling, refining, blending and retail outlets etc.);
  • (f) All underground or partially  underground  structures  of  five hundred square meters or above used for any purpose or occupancy;
  • (g) Places of Assembly like Auditoria, convention halls,  Assembly  halls, recreation halls etc. having a built up area of five hundred square meters and above on any one or more floors where people congregate or gather for amusement,  recreation,  social,  religious or any other similar purposes.
  • (h) Business or office buildings—
    • (i) having a height of twelve meters and above; or
    • (ii) having a built up area of five hundred square meters  or  above;
  • (i) Clinical Establishments—
    • (i) clinical establishments having height of twelve meters and above or’
    • (ii) functioning in buildings having more than  three  floors including all underground, basement, stilt and mezzanine floors or,
    • (iii) having more than thirty beds or,
    • (iv) having any Critical Care Unit.
  • (j) Educational Buildings—
    • (i)having a height of twelve meters and above or,
    • (ii)having a built up area of one thousand square meters or above; or
    • (iii)having three storied building;
  • (k) Hotels, Lodgings and Guest Houses—
    • (i)having a height of twelve meters and above or,
    • (ii)having a built up area of five hundred square meters or above,
    • (iii)of three Star and above categories,
    • (iv)having places of Assembly like Auditoria, Convention Halls, Assembly Halls, Recreation Halls etc. of built up area of five hundred square meters and above on any one or more floors where people congregate or gather for amusement, recreation, social , religious and similar other purposes;
  • (l) Malls, shopping complexes and mercantile buildings—
    • (i)having a height of nine meters and above or,
    • (ii)having a built up area of five hundred square meters or  above,
  • (m) Residential Buildings (other than hotels, lodgings and guest houses), having a height of fifteen meters and above;
  • (n) Temporary structures of one thousand square meters or more or where the congregation of persons is two thousand or more or premises where highly flammable or explosive materials are proposed.
  • (o) Warehouses or Storage area of five hundred square meters  built  up area or above;
  • (p) Any other classes of buildings or premises notified by the State Government from time to time”.

            The authorized person (s) of the aforesaid occupancies / premises is required to apply for Fire Safety Recommendation to the authorized officer of the Odisha Fire Service at the time of commencement of the project. On completion of the project the authorized person (s) of the said premises shall apply for Fire Safety Certificate along with fire safety installations as recommended by the said authorized officer of the Fire Service.

Q.2-  What are the modes of Application?
Ans: -Application may be made to the authorized officer of the Odisha Fire Service either by Regd. Post or in person or online. Whereas online mode of application is encouraged. As per Govt. Notification No.-35463/CD, Bhubaneswar, Dtd.03.11.2020, Fire Safety Recommendation and Fire Safety Certificates for Industries, Commercial Establishments and Businesses shall be dealt with online web systems only.
Q.3-     How to apply for Fire Safety Recommendation for different buildings / premises / occupancies (permanent constructions)?

Application can also be made through offline mode by Regd. Post or in person. In such cases the application shall be in plain paper being signed by the applicant along with drawing containing site plan, layout plan, floor plan, elevation plan.
Q.4-     How to apply for Fire Safety Certificate for different buildings / premises / occupancies (permanent constructions)?

The applicant can also submit his application offline in Form-III addressed to the authorized officer along with fire safety installation plan and documents as prescribed in Rule-12 (1) and such application may be made either by Regd. Post or in person.
Q.5-     What are the fees to be paid for Fire Safety Recommendation / Fire Safety Certificate?

Ans:


Residential Building

@ Rs.1/- (rupees one) per square meter built up area

Non-Residential Building

@ Rs.2/- (rupees two) per square meter built up area

NB:      Fees are the same in case of Renewal of Fire Safety Certificate.

Q.7-     Whom do I address my application?

Ans: - The application is to be addressed to the authorized officer for issuance of Fire Safety Recommendation / Fire Safety Certificate in respect of different fire risk premises as the Govt. order No-50908/BBSR dtd.19.11.2019 is as fullows: -

  • Temporary Structure: - For Fire Safety Recommendation / Fire Safety Certificate for temporary structure, Station Officer / Asst. Station Officer of the fire station concerned.
  • Other than Temporary Structure: - The Authorized Officer for different fire risk premises other than temporary structure are as fullows: -

CAF Rule:-     When Common Application Form for the purpose of occupancy of the building as per CAF Rules is mandated by Planning Authorities in the State, the fire service inspection shall be conducted within 15 days of the receipt of the Common Application Form and the Fire Safety Certificate shall be provided within 3 days after the common inspection.
Q.8-     What will be the rule of the authorized officers after submission of application for Fire Safety Recommendation?
Ans: -  After submission of application along with required fees and relevant documents, the authorized officer shall schedule a convenient date for site inspection and issue Fire Safety Recommendation to the applicant within 30 days. If there are any shortcomings in implementing recommendation in Fire Safety measures, the period for compliance shall be excluded from the time limit.  
Q.9-     What will be the rule of the authorized officers after submission of application for Fire Safety Certificate?
Ans: -  After submission of application along with required fees and relevant documents, the premises / buildings shall be inspected in presence of owner or his representative by the authorized officers to ascertain the adequacy and operability of the fire prevention and fire safety measures etc. On being satisfied by authorized officer may issue Fire Safety Certificate within 18 (eighteen) days of receipt of his application and if not found satisfactory, he may require the owner to rectify deficiencies or shortage or recommend to provide such additional measures as may be necessary within a specified time.

If there are any shortcomings in implementing recommendation in fire safety measures, the period for compliance shall be excluded from the time limit.

Q.10-   Is there any time limit for issuance of Fire Safety Recommendation / Fire Safety Certificate and NOC?
Ans: -  Yes, in accordance with provision of ORTPS Act-2012 amended 2020 and G.A & P.G (AR) Department Gazette Notification No-893 dtd.03.06.2020.

  • Duration / Time
  • i) For Fire Safety Recommendation- 30 Days.
  • ii) For Fire Safety Recommendation under CAF Rules- 18 days.
  • iii) For Fire Safety Certificate- 18 Days.

     Only after implementation of Fire Safety Recommendation for the ongoing project the occupant / owner should apply for Fire Safety Certificate. The time frame / limits shall be counted after receiving of such request. However if there are any shortcomings in implementing recommendation in Fire Safety  measures, the period for compliance shall be excluded from the time limit.


Q.11-   What is the period of validity and what am I suppose to do after the expiry of Fire Safety Certificate?
Ans: -   The validity period of Fire Safety Certificate is 02 years for all the occupancies / premises except Residential building which is valid up to 05 years. The owner / occupier should apply for renewal at least 03 months before expiry of Fire Safety Certificate.
Q.12-   Whom can I appeal in case Fire Safety Certificate / Fire Safety Recommendation not issued within time limit or if I have any grievance?

TEMPORARY STRUCTURE

Q.13-   What is the meaning of Temporary Structure?
Ans: - “Temporary Structure” means a structure with roof or walls made of wood, bamboo, straw, hay, grass, mats, canvas, tarpaulin, cloth, pulythene, thermoplastic or other like materials, for use a place on temporary basis for a specific period, where public may assemble but not adopted for permanent or continuous occupancy.
Q.14-   What are the kind of Temporary Structures that require Fire Safety Recommendation / Fire Safety Certificate?
Ans: - Temporary Structures over an area of 1000 square meters or more or where the congregation of persons is more than 2000 or more for the purpose of observation of festivities, for hulding commercial shows, melas, jatras, operas, temporary cinemas etc. or premises where highly flammable or explosive materials are proposed to be used.
Q.15-   How to apply Fire Safety Recommendation and obtain Fire Safety Certificate for Temporary Structure?
Ans: - The applicant is advised to apply on online portal, “agnishamaseva.odisha.gov.in”. However, the applicant can submit his application addressed to the authorized officer (concerned Station Officer of the fire station limit jurisdiction) by Regd. Post or in person. The application shall be in plain paper being signed by the applicant along with the sketch map of the site with layout, means of access, entrance, exit etc. before 07 days of construction for issue of Fire Safety Recommendation.
            On receipt of application the premises shall be inspected by the authorized officers in presence of applicant or his authorized representative. If the site is found suitable the applicant shall be issued with Fire Safety Recommendation. On receipt of compliance from applicant the site will again be inspected by the authorized officers and on being satisfied about conformity of the structures as per Fire Safety Recommendation issued earlier, the authorized officers shall issue Fire Safety Certificate within 3 days of receipt of compliance report requiring the applicant to rectify the deficiencies, if any, then the applicant has to provide such additional measures as may be necessary, within a specified time with intimation to licensing authority.
            If compliance is not received within the specified time, the application may be rejected and the applicant has to make a fresh application.
Q.16-   What is the procedure of Temporary shops for possession and sale of fireworks during festivals?
Ans: -  The procedure to obtain Fire Safety Recommendation and Fire Safety Certificate for Temporary Fire Crackers Shop is same as mentioned in FAQ-15.

   During festivals, the District Magistrate may issue temporary license for possession and sale of fireworks in a temporary shop subject to the fullowing conditions namely:-

  • (1)The fireworks shall be kept in a shed made of non-flammable material, which is closed and secured so as to prevent unauthorised persons having access thereto.
  • (2)The sheds for possession and sale of fireworks shall be at a distance of at least three meters from each other and fifty meters from any protected work.
  • (3)The sheds shall not face each other.
  • (4)No oil burning lamps, gas lamps or naked lights shall be used in the shed or within the safety distance of the sheds. Electrical lights, if used, shall be fixed to the wall or ceiling and shall not be suspended by flexible wire. Switches for each shop shall be fixed rigidly to the wall and a master switch shall be provided for each row of sheds.
  • (5)Display of fireworks shall not be allowed within fifty meters of any shed.
  • (6)In one cluster not more than fifty shops shall be permitted.
